There is ongoing litigation between the California Department of Education (CDE) and the Concerned Parent Association. A Notice issued by the State Superintendent of Public Instruction Tom Torlakson states, “The lawsuit accuses CDE of widespread, systematic non-compliance by local educational agencies with the Individuals with Disabilities Education Act (IDEA) and Section 504. The CDE denies these allegations and is actively defending the litigation”.
The court has ordered CDE to release student and parent information to provide personally identifiable information (PII) of children, including children with disabilities, children who requested an assessment or who were assessed for special education services, and children who are attending or who have attended a California school at any time since January 1, 2008.
Parents, guardians and former students over the age of 18 have the right to object to the release of protected student personal information and records by notifying the court in writing by April 1, 2016.
